1. Information We Collect

Remity Staffing USA ("Company," "we," "us," or "our") collects information you voluntarily provide when registering as a candidate or employer, including: full name, contact details, professional credentials, employment history, Social Security Number (for tax and background check purposes), professional licenses, certifications, and references. We also collect automatically generated data including IP address, browser type, and usage data via cookies and analytics tools.

2. How We Use Your Information

We use collected information to: match candidates with appropriate job opportunities; conduct background checks, drug screenings, and credential verifications; fulfill contractual obligations to client healthcare facilities; communicate regarding placements and compliance requirements; process payroll and submit required tax filings (W-2, 1099); comply with federal and state legal obligations; improve our website and service delivery.

3. Data Sharing

We share your information only with: (a) client healthcare facilities to whom you are placed or being considered for placement; (b) background check and drug screening providers; (c) payroll processors and benefits administrators; (d) government bodies as required by law (including EEOC, DOL, IRS, DHS); (e) legal and compliance advisors under attorney-client privilege. We do not sell your personal data to third parties for marketing purposes.

4. Your Rights

Under applicable US state privacy laws (including CCPA for California residents), you have the right to: access the personal data we hold about you; request correction of inaccurate data; request deletion of your data (subject to legal retention obligations); opt out of certain data sharing practices; not be discriminated against for exercising your privacy rights. 5. Data Retention

We retain candidate records for a minimum of seven (7) years following the last placement or application, in accordance with federal and state employment record-keeping requirements. Credential and compliance documents are retained for the duration required by Joint Commission and applicable state nursing board regulations.

We implement industry-standard technical and organizational security measures including SSL/TLS encryption, access controls, and regular security assessments. However, no internet transmission is 100% secure. We encourage users to use strong passwords and contact us immediately if they suspect unauthorized access.

Terms of Service

1. Acceptance of Terms

By accessing or using any services offered by Remity Staffing USA LLC ("Remity"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, you must discontinue use of our services immediately.

2. Services Provided

Remity provides healthcare staffing solutions including temporary (contract/travel), per diem, and permanent placement services for registered nurses (RN), licensed practical nurses (LPN), certified nursing assistants (CNA), physical therapists, occupational therapists, pharmacists, and allied health professionals across the United States.

3. Candidate Obligations

Candidates agree to: provide accurate, truthful, and complete information at all times; maintain current and valid licensure in all states where they accept placements; comply with all facility policies, procedures, and applicable laws during assignments; notify Remity immediately of any license suspension, revocation, or criminal charge; complete all required compliance documentation before commencing any assignment.

4. Client Facility Obligations

Client healthcare facilities agree to: provide a safe working environment compliant with OSHA standards; not engage Remity-placed clinicians in unauthorized activities outside their licensed scope of practice; pay all invoices within the agreed net payment terms; not directly hire any Remity-placed candidate within 12 months of placement without paying the applicable conversion fee.

5. Limitation of Liability

Remity's liability to any party shall not exceed the fees paid by that party to Remity in the three (3) months preceding the claim. Remity is not liable for consequential, incidental, or punitive damages. Clinical decisions and patient care outcomes are the sole responsibility of the placed clinician and the client healthcare facility.

6. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Pinellas County, Florida, or through binding arbitration under AAA rules at Remity's election.

HIPAA Compliance Policy

Business Associate Status

Remity Staffing USA operates as a Business Associate under HIPAA when we handle Protected Health Information (PHI) on behalf of covered healthcare entity clients. We execute Business Associate Agreements (BAAs) with all client facilities as required by 45 CFR Part 164.

PHI Safeguards

We implement administrative, physical, and technical safeguards to protect any PHI we access or process, including: role-based access controls; encryption of PHI in transit and at rest; regular workforce HIPAA training; breach detection and response procedures; minimum necessary standard for all PHI access.

Candidate Health Information

Health information collected during the credentialing process (including drug screen results, TB tests, vaccination records, and physical examination results) is used solely for employment compliance purposes and is not disclosed to unauthorized parties. Candidates' medical information is maintained separately from general employment records in accordance with ADA requirements.

Breach Notification

In the event of a reportable HIPAA breach, we will notify affected covered entity clients, affected individuals (where required), and the HHS Office for Civil Rights within the timeframes mandated by the HIPAA Breach Notification Rule (45 CFR Part 164, Subpart D).

At-Will Employment Statement

Unless a written employment contract specifying a definite term of employment has been executed by an authorized officer of Remity Staffing USA, all employment relationships with Remity are "at-will." This means that either Remity or the employee/contractor may terminate the employment relationship at any time, for any lawful reason, or for no reason at all, with or without advance notice.

For contract and travel healthcare professionals, employment with Remity exists only for the duration of an approved assignment. Completion of one assignment does not guarantee subsequent assignments. The acceptance of an assignment offer does not alter the at-will nature of employment.

Exceptions

At-will employment does not supersede: protections under the National Labor Relations Act; FMLA leave rights; USERRA rights for military service members; whistleblower protections under applicable federal and state laws; any written contract signed by an authorized Remity officer.

ACA / Employee Benefits Compliance Policy

ACA Compliance

Remity Staffing USA complies with all requirements of the Affordable Care Act (ACA), including: offering minimum essential coverage (MEC) to full-time employees (30+ hours per week average); issuing accurate Form 1095-C (Employer-Provided Health Insurance Offer and Coverage) to all applicable employees annually; filing required information returns (1094-C/1095-C) with the IRS by applicable deadlines.

Benefits Eligibility

Travel and contract healthcare professionals who average 30 or more hours per week over a measurement period of 12 consecutive months are eligible for health insurance benefits as defined in the Remity Benefits Summary. Benefits information is provided to all eligible employees upon offer of a qualifying assignment. Employees may waive coverage by completing the required waiver form.

COBRA Rights

Upon qualifying events (including end of assignment, reduction in hours, or termination), eligible employees and their qualified dependents have the right to continue group health coverage under COBRA for up to 18 months (or longer in certain circumstances). COBRA election notices are issued within 14 days of notification of a qualifying event.

ERISA Compliance

All benefit plan documents, Summary Plan Descriptions (SPDs), and Summary of Benefits and Coverage (SBC) documents are maintained in compliance with ERISA and are available to plan participants upon request within 30 days.

OSHA / Workplace Safety Policy

Our Commitment to Safety

Remity Staffing USA is committed to providing a safe and healthy work environment for all employees in compliance with the Occupational Safety and Health Act of 1970 and applicable OSHA standards, including the OSHA Bloodborne Pathogens Standard (29 CFR 1910.1030) which is particularly relevant to healthcare settings.

Shared Employer Responsibility

As a staffing agency, Remity and the host client facility share OSHA compliance responsibilities. Remity ensures all placed healthcare professionals receive: training on bloodborne pathogen exposure control; information on the host facility's safety policies prior to assignment commencement; PPE requirements and availability; hazard communication (HazCom) training relevant to their clinical setting. Host facilities are responsible for providing a workplace free from recognized hazards and for facility-specific safety orientation.

Injury Reporting

All work-related injuries, illnesses, or exposures must be reported to Remity immediately (within 24 hours). Remity maintains OSHA 300 logs as required and reports severe injuries (hospitalization, amputation, loss of an eye) to OSHA within 24 hours. Needlestick and sharps injuries are documented per OSHA's Needlestick Safety and Prevention Act requirements.

Workers' Compensation

All Remity employees are covered by workers' compensation insurance in compliance with applicable state laws. Information on filing a workers' compensation claim is provided in the new hire packet and is available at any time by contacting hello@remitystaffing.com.

Modern Slavery & Anti-Human Trafficking Policy

Zero Tolerance Commitment

Remity Staffing USA has zero tolerance for modern slavery, human trafficking, forced labor, debt bondage, or any form of exploitation in our operations or supply chain. This policy applies to all employees, contractors, candidates, and third-party suppliers worldwide.

International Recruitment Safeguards

For all international nurse recruitment (from UK, India, Philippines, Nigeria, and other source countries), Remity expressly prohibits: charging recruitment fees to candidates; confiscating or retaining identity documents; misrepresenting employment terms, conditions, or compensation; any form of debt bondage or coercive recruitment practice. All international placements comply with the Employer-Paid Recruitment Fee Standard and applicable source-country recruitment regulations.

Supply Chain Due Diligence

We conduct due diligence on third-party recruitment partners and international sourcing agencies to ensure alignment with this policy. Partners found to be in violation are immediately terminated.

Immigration & I-9 / E-Verify Compliance Policy

Employment Eligibility Verification

Remity Staffing USA verifies the employment eligibility of all new hires in compliance with the Immigration Reform and Control Act (IRCA) of 1986. Form I-9 is completed for every new hire within three (3) business days of commencement of employment. I-9 forms are retained for three years from the hire date or one year after termination, whichever is later.

E-Verify

Remity participates in the federal E-Verify program to confirm the identity and employment authorization of all new hires. E-Verify queries are initiated no later than three business days after the employee's first day of work. Remity follows all E-Verify program rules including anti-discrimination provisions and the requirement not to take adverse action based on a tentative non-confirmation (TNC) until the process is complete.

Non-Discrimination

Remity does not discriminate in hiring based on citizenship status or national origin beyond what is required by law. We do not request more or different documents than required for I-9 completion, and we do not reject valid documents that reasonably appear genuine.

International Placement Visas

For internationally educated nurses and allied health professionals, Remity coordinates EB-3 immigrant visa sponsorship and H-1B non-immigrant visa sponsorship in compliance with all USCIS, DOL, and DOS regulations. All visa-related fees required by law to be paid by the employer are borne by Remity or the client facility, not the candidate.

FLSA / Wage & Hour Compliance Policy

Minimum Wage Compliance

Remity Staffing USA pays all non-exempt employees at or above the applicable federal minimum wage ($7.25/hr) or applicable state/local minimum wage, whichever is higher. Remity monitors minimum wage rates across all 50 states and adjusts compensation accordingly when clinicians are placed in jurisdictions with higher minimum wage requirements.

Overtime

Non-exempt employees are compensated at one and one-half (1.5x) their regular rate of pay for all hours worked in excess of 40 hours per workweek, in accordance with FLSA Section 7. Remity's workweek begins on Sunday at 12:00 AM and ends on Saturday at 11:59 PM. State-specific daily overtime requirements (including California's daily OT after 8 hours) are honored where applicable.

Travel Time & Stipends

Housing and travel stipends provided to qualifying travel nurses and allied health professionals are structured in compliance with IRS Publication 463 and applicable DOL guidance to ensure proper tax treatment. Remity does not structure compensation packages in a manner that violates FLSA or results in effective hourly rates below minimum wage.

Record Keeping

Remity maintains accurate time and payroll records for all non-exempt employees for a minimum of three (3) years as required by FLSA. Employees are encouraged to review their pay stubs and report any discrepancies promptly to hello@remitystaffing.com.
